In the last 18 months, I litigated 3 Medical Marijuana Grow House cases in Adams County. All three were dismissed completely. Each client was able to keep his medical license and caregiver status.
Recently, I won a DUI case where my client drove through, but did not stop at a DUI Checkpoint in Jefferson County. The jury came to understand that my client was not wearing his glasses and incorrectly thought the checkpoint was an accident scene that he simply needed to travel through at a slow speed. The jury also saw that the police started assuming DUI and did a lousy investigation.
I tried an Aggravated Robbery of a Dispensary. This case received a lot of press, often referring to my client as a Ninja Machete Dispensary robber. My client was found not guilty of using or possessing a deadly weapon allowing the court to give her to probation, rather than a 10 year minimum mandatory prison sentence. She was carrying a 2 foot sword.
I currently represent a gentleman accused of a pattern of sexual assault on a child. The prosecution tried to deny his constitutional right to confront the witnesses against him. I was able to show the Court that the prosecutor did not properly follow the procedures. The case is set for hearing on a motion to dismiss for violation of speedy trial.
In the last year or so, I have been able to get several DUI cases dismissed. In one, I successfully argued that the police destroyed excupatory evidence, thereby violating my client's due process rights. In another, the judge agreed with my argument that the police did not have probable cause to arrest my client. In a third, the prosecutor agreed the police did not have sufficient reason to contact my client. In a fourth, the court dismissed the case after I demonstrated that the police did not follow required chemical testing procedures.
Further, in a recent DUI trial, the jury acquitted my client after I showed the police did not follow the correct procedures on SFSTs (roadside sobriety tests).
A few weeks ago, my client was acquitted by a jury of the felony of Menacing a census worker with a deadly weapon. This was an important gun rights victory. He was standing on his own porch asking the trespasser to leave his property while having an assault rifle in his hands. The trespasser ignored several posted private property and no trespassing signs. This case proved that you have 2nd Amendment rights, even in Boulder County.
